A common misunderstanding about which workers are eligible to vote is just one of many procedural traps that regularly make German elections for severely disabled employee representatives (SBV) legally vulnerable. A new briefing from the Institute for Works Council Training (ifb) outlines the pattern.

Election committees underestimate the risks, especially when deciding whether to use the simplified or the standard voting procedure and when drawing up the voter rolls. Those seemingly minor steps, the ifb says, can produce mistakes serious enough to allow a legal challenge against the entire election.

The Voter Eligibility Quagmire

Defining the exact circle of eligible voters is the central preparatory task. A classic error: employees who are in the passive phase of partial retirement (Altersteilzeit in the Freistellungsphase) are not entitled to vote. If they are mistakenly included or excluded, the voter list becomes defective.

Timing is another hazard. When a worker’s legal status as “severely disabled” is revoked, the Social Code (SGB IX) grants a grace period. That window ends exactly three full calendar months after the revocation becomes incontestable. Election committees that lose track of the dates risk a flawed roll.

Simplified or Regular? The 50-Person Threshold

The election rules depend on the size of the workforce. If fewer than 50 eligible voters work in the company, the simplified election procedure is mandatory. Above that number, the more complex regular procedure kicks in. Confusing one with the other can undermine the entire vote.

Postal voting in the simplified procedure is allowed only under one condition: the election meeting must be held digitally. Regardless of the format, secret balloting is compulsory. Any breach makes the election contestable.

Three Members, One Tiebreaker

By law, the election board must consist of exactly three members. The election regulations for severely disabled representatives (SchwbVWO) also permit the appointment of alternate members to ensure the board can function.

What happens if votes are tied? No runoff election exists. The outcome is decided by drawing lots—a rule that many election committees apparently overlook, the ifb warns.

The legal solidity of SBV elections matters directly because they set up the permanent representation system for severely disabled employees in the workplace. With so many procedural landmines, the institute’s briefing aims to help election boards avoid the most common pitfalls.
