German companies handling hazardous substances face a tightening regulatory landscape as multiple EU directives take effect this summer, pushing documentation requirements into the digital age and exposing employers to fines of up to €50,000 for missing records.

The most immediate change arrives on August 12, when the new EU Packaging and Packaging Waste Regulation (PPWR) enters into force. Brussels withdrew its earlier opinion on Germany's national packaging law on July 1, effectively replacing the old framework. German online retailers must still register with the central packaging register LUCID, but existing registrations benefit from a transition period until November 12.

Alongside packaging rules, the Technical Rule for Operational Safety (TRBS 1115-1) is tightening requirements for measurement, control, and regulation equipment. Companies must now implement a complete security lifecycle that includes network segmentation and strict access controls. For operators of critical infrastructure (KRITIS), a 2026 update to the KRITIS ordinance broadens the focus to overall resilience, bringing sectors such as pharmaceutical precursor production and logistics under closer scrutiny.

AI-Driven Tools Step In to Manage Compliance Burden

A wave of digital platforms is emerging to help businesses keep pace with the complex rules. Avyronis offers modular, AI-powered HSEQ management solutions with pricing starting at €49 per month for the basic version and rising to €390 for enterprise packages. A dedicated digital hazardous-substance module is expected to launch shortly.

Another provider, Gefahrstoff-QR, is piloting a system that automatically analyzes safety data sheets. The software flags expired documents, requests updated versions directly from suppliers, and generates QR codes that employees can scan on the shop floor to access the latest information. The company is currently seeking pilot customers to test the technology.

Documentation Gaps Can Prove Costly

The legal foundation for record-keeping remains unforgiving. Under §6 paragraph 12 of the German Hazardous Substances Ordinance (GefStoffV), any employer using even a single hazardous substance must maintain a register listing its name, hazard statements (H-phrases), quantities, work areas, and references to safety data sheets. Failure to produce that register can trigger fines of up to €50,000.

Additionally, §5 of the Occupational Safety and Health Act (ArbSchG) requires every employer to conduct risk assessments that are activity-specific. The same chemical can lead to different risk evaluations depending on how it is used. The Simple Hazardous Substances Control Concept (EMKG) is commonly applied for classification. Once a company has ten or more employees, systematic documentation becomes mandatory. Since 2013, psychological stressors must also be explicitly factored into assessments.

A webcast on data management platforms takes place today, followed by a subject-specific webinar on chemical law in mid-August.
