Fundamental Challenges Overshadow Legal Issues

The Centers for Medicare & Medicaid Services (CMS) has indicated a stark change in its reimbursement policy. In late March, UnitedHealth was added directly to the top ten holdings of the prestigious Schwab U.S. Dividend Equity ETF (SCHD). With a current dividend yield of approximately 3.2 percent, the company is increasingly attracting the attention of value investors betting on a long-term bottom formation.

However, a pending appeal court case could carry substantially greater weight. This proceeding centers on allegations of misleading sales practices related to Medicare Advantage plans. The outcome is critical; if existing legal protections afforded by government regulations are stripped away, it could expose UnitedHealth and the entire sector to far-reaching liability consequences.

All Eyes on the Medical Cost Ratio

The next major test arrives on April 21, when management will release quarterly earnings. Market experts are forecasting a profit of $6.62 per share. Investor focus, however, will be almost exclusively trained on the trajectory of the medical cost ratio. The company must demonstrate that its internal cost-control initiatives are effective to credibly support its stated full-year earnings target of at least $17.75 per share.
