SK Hynix Sues Two Patent Licensors While Testing Memory Chips in Orbit

SK Hynix has opened a new legal front in the United States, filing a declaratory judgment action on Thursday against licensing firms Longhorn IP and Mago Barca IP. The complaint, lodged with the U.S. District Court for the Northern District of California, is docketed as a patent dispute. Through the move, the South Korean chipmaker is seeking a court ruling on the scope of existing intellectual property rights, aiming to head off potential litigation in the American market before it materializes.
The legal maneuver unfolded alongside a decidedly different kind of test. On Wednesday, Nara Space Technology's small satellite E3T Unit 2 lifted off aboard South Korea's fifth Nuri launch vehicle, carrying memory chips manufactured by SK Hynix together with other domestically produced components. Once in orbit, the satellite established a normal two-way radio link with its ground station. The mission is designed to observe how the memory devices perform under the harsh conditions of space, though no initial test data from the orbit has been released so far.
A Bruising Week for Memory Stocks
Trading in SK Hynix shares reflected broader sector turbulence rather than anything specific to the company. The stock shed 2.4% on Friday, the final session of the week, closing at KRW 1,681,000.00. Weakness across the semiconductor segment set the tone for Asian markets after rival Samsung Electronics posted disappointing preliminary quarterly figures, with macroeconomic forces piling on additional pressure.
Thursday had already brought substantial headwinds. Beyond Samsung's miss against market expectations, climbing U.S. Treasury yields and rising oil prices weighed on valuations across technology and chip names. Mounting concerns about future memory supply and pricing added to the gloom, dragging peers Micron and SanDisk into the selloff as well. Market reports attributed the declines to those supply and pricing worries rather than to any company-specific downgrades.
Should investors sell immediately? Or is it worth buying SK Hynix?
Friday's retreat also drew mechanical support from the expiration of a 90-day lockup on certain SK Hynix shares, which released additional stock for trading. Analysts pointed to other dampening factors ahead of the company's own results, including a stronger won and anticipated special costs for employee bonuses.
Earnings on the Horizon
Attention now turns to SK Hynix's third-quarter 2026 report, which media reports indicate will be published on October 27. Despite the recent consolidation, the stock remains a standout performer, up 159% since the start of the year. The question for market participants is how firmly SK Hynix's profitability can hold up against the broader headwinds buffeting the memory sector.
Sentiment among analysts remains constructive. On Wednesday, Kim Woon-ho of IBK Investment & Securities reaffirmed his buy rating with a price target of KRW 4 million. He projected third-quarter 2026 revenue of KRW 95.8 trillion and operating profit of KRW 75.1 trillion, citing growing demand for memory chips used in artificial intelligence systems set against tight supply.
Solidigm Speculation Meets a Firm Denial
Off the operating front, management addressed plans surrounding subsidiary Solidigm. SK Hynix said on October 1 that no decisions have been made regarding the unit's capital plans, including any potential external financing. Every option, the company said, will be judged by its impact on existing shareholders and long-term corporate value — a response aimed at quelling speculation about short-term capital measures at the U.S. subsidiary.
Media reports had suggested Solidigm selected Goldman Sachs and Morgan Stanley as lead underwriters for a possible initial public offering in 2027, with estimates putting potential proceeds at roughly USD 10 billion. SK Hynix made clear that no decision on an IPO has been reached.
