A legal maneuver by Oracle has rattled investors in Bloom Energy, but the underlying story is more about permitting bottlenecks than broken partnerships.

Shares of the fuel-cell specialist came under pressure after Bloomberg reported that Oracle had issued a force majeure notice to developer Blue Owl Capital regarding the planned "Project Jupiter" data center in New Mexico. The filing is designed to defer contractual payments should the campus miss its targeted 2028 operational start. The stock shed 7.0% in today's trading to EUR 224.50, following a 3.1% decline in the prior session that left it at EUR 234.00.

A Pipeline, Not a Chip, Is the Hold-Up

The New Mexico campus is designed to draw roughly 2.45 gigawatts, with Bloom Energy's solid-oxide fuel cells meant to supply on-site power. What has thrown the schedule off course is not server hardware but primary energy supply: an Energy Transfer natural gas pipeline feeding the fuel-cell system has slipped nearly six months to February 1, 2027, after repeated permit rejections from the New Mexico State Land Office. The original completion target had been August 2026.

Oracle's decision to pursue legal steps to postpone payments until the facility actually comes online is commercially logical. The company has stressed it remains committed to the site and will stay on as anchor tenant, and the developer's management has likewise confirmed that the contractual foundations remain intact. Delays are close to inevitable for megaprojects carrying an estimated total volume of up to USD 165 billion once state agencies and environmental groups file objections.

Why One Site Doesn't Sink the Thesis

The more relevant question for shareholders is how much Bloom depends on any single location. The business model, in my view, cushions precisely this kind of risk.

Of the framework agreement with Oracle expanded in April to as much as 2.8 gigawatts, roughly 1.2 gigawatts are contractually locked in. Bloom CEO K.R. Sridhar already noted in the most recent second-quarter report that the annual forecast does not hinge on one singular project. The company's servers are modular and can be redirected with relative ease to other sites where large customers are scrambling for uninterrupted power.

With conventional grids overloaded in many regions and new connections taking years, on-site fuel cells remain one of the few workable bridge technologies for power-hungry AI campuses. That demand backdrop suggests freed-up capacity should be rebooked elsewhere before long.

Valuation Leaves Little Room for Error

Even so, the warning signs deserve attention. Up 212% since the start of the year, the stock has already priced in enormous optimism, and at this valuation any operational delay translates into sharp corrections. A separate pending class action adds to the unease, with the lead-plaintiff deadline set for September 28. The allegations concern purported misstatements about dependence on scandium supplies from China. Combined with the New Mexico pipeline standoff, these factors are likely to keep volatility elevated in the coming weeks.

On balance, the long-term picture still carries more weight. The force majeure signal out of New Mexico is a wake-up call for the entire sector, illustrating how complex it is in practice to bring new power capacity online. It does not, however, amount to a fundamental break in Bloom Energy's growth story. As long as global appetite for data-center electricity holds, the company's modular generation technology remains strategically well placed.
