The enforcement regime is severe. Violations of transparency duties can trigger fines reaching €15 million or 3 percent of global annual turnover. More egregious breaches involving prohibited practices escalate the stakes dramatically: up to €35 million or 7 percent of worldwide revenue.
Systems already on the market when the rules took effect receive a grace period. Those existing applications must achieve compliance by December 2, 2026. Additional AI Act milestones loom on the horizon — a ban on sexualized deepfakes arrives in December 2026, while high-risk AI regulations phase in gradually through August 2028.
National Oversight Takes Shape
Germany has designated the Federal Network Agency (Bundesnetzagentur) as its central AI supervisory authority. Austria's Federal Chancellery, for its part, has already rolled out a unified labelling model across public administration, debuting with the chatbot "ida." That framework comprises four core duties: chatbot disclosure, technical marking of generated content, notification when emotion recognition is used, and deepfake labelling.
Austrian critics point to a conspicuous gap — no official supervisory body has been named yet. The Green Party and the organisation epicenter.works have both voiced objections to this unresolved issue.
At the EU level, the newly established AI Office wields substantial enforcement powers. It can launch investigations, demand access to AI models and, in severe cases, pull products from the market entirely.

Industry Pushback and Technical Realities
The rollout has not gone smoothly. eco, the German internet industry association, slammed the European Commission for publishing essential guidance a mere 13 days before the deadline. Clear technical standards for coordinated cross-border practice remain absent, the group argued. Google has also cautioned that the regulatory complexity of the undertaking is considerable.
Technical experts point to practical limitations as well. Invisible watermarks can be defeated through pixel noise manipulation, while more robust methods carry significant costs. Open-source AI models, in particular, could circumvent labelling requirements altogether. Future reliability may hinge on standards such as C2PA or detection techniques based on reconstruction errors.
The stakes are underscored by fresh research from the University of Leipzig. Survey data shows only 25 percent of respondents feel confident identifying deepfakes reliably — even though more than two-thirds reported having already encountered such content.
