Brazilian Rare Earths Faces Legal Challenge as Scoping Study Points to US$6 Billion Prize
Published on 10/21/2026 at 18:02 | Editorial boerse-global.deBrazilian Rare Earths is juggling technical milestones, a multi-billion-dollar study and a courtroom fight all at once. The company's September 2026 quarterly report, released yesterday, sketches a project with striking headline economics and a debt-free balance sheet — but also one whose commercial future hinges on permits, resource upgrades and a legal dispute that remains unresolved.
The most eye-catching figures come from the integrated scoping study linking the Monte Alto deposit to processing at Camaçari. It puts the after-tax net present value at US$6.0 billion, with an internal rate of return of 90% and a payback period of 1.1 years. Average annual free operating cash flow is pencilled in at US$1.2 billion, while costs are estimated at roughly US$21 per kilogram of NdPr equivalent.
Those numbers carry heavy caveats. The study's preliminary accuracy sits at about ±40%, and the modelling leans on long-term Argus price assumptions for Europe and the United States. Brazilian Rare Earths itself stresses that the projected economics are preliminary and depend on the stated assumptions — modelled potential is not the same as realised earnings. The geological base is similarly mixed: about 75% of the production target rests on indicated resources and 25% on inferred, with an updated resource estimate targeted for the fourth quarter of 2026.
Cash, Partners and a First Batch of Concentrate
As of 30 September 2026, the company reported liquid funds of A$121.8 million and no debt facilities. That gives it room to keep developing the project, though it does not by itself prove the later commercial operation can be fully financed — nor that it will be approved.
Should investors sell immediately? Or is it worth buying Brazilian Rare Earths?
On the operational side, Brazilian Rare Earths has produced its first rare earth concentrate at the pilot plant in Camaçari. It is a genuine technical step, but it does not erase the study's caveats or demonstrate a durable commercial operation. Commissioning of the second hydrometallurgical pilot stage is planned for the second quarter of 2027, with partners covering 59% of that stage's funding. A binding ten-year European offtake agreement with Carester for heavy rare earths adds a sales channel for later output. The two arrangements should not be conflated: partner funding for piloting is not a commitment to finance the entire integrated project.
Sellers Sue Over A$1 Share Buyback
Media reports on Thursday said Brazilian sellers of mineral rights are suing over the contractual buyback of four million shares at A$1 apiece. The sellers claim they were harmed; Brazilian Rare Earths says it simply exercised a contract clause. The case before a federal court remains open. The plaintiffs succeeded in keeping the company and its law firm in the proceedings, but that is not a final ruling on the competing positions.
Permits and Uranium Add Another Layer
Environmental and licensing questions also moved into focus yesterday. According to media reports, operations still require environmental and radiation protection licences; the existing permit for experimental mining is not equivalent to full operating approval. The report also flags overlaps between mining activities and protected areas, with residents describing pressure to sell land — allegations that must be distinguished from established legal violations but that point to potential conflict zones.
Brazilian Rare Earths at a turning point? This analysis reveals what investors need to know now.
Uranium needs separate treatment. Radiation authority ANSN has not approved uranium production. Any extraction of uranium concentrate at Camaçari would require authorisation, and uranium revenue is excluded from the study economics.
Shares were down 9.9% on the day, a sharp contrast with the operational progress reported. For fundamental assessment, what matters is whether the study's economics hold up, how the liquidity is deployed and how the lawsuit ends — not the daily move alone.
