Bloom Energy's 239% AI Surge Faces a Legal Deadline Over Hidden Chinese Scandium

Bloom Energy faces securities class actions over alleged undisclosed China-linked scandium sourcing, as its stock stays up 239% year-to-date.

The pitch that has powered Bloom Energy's stock through the roof rests on a simple promise: on-site solid-oxide fuel cells that free power-hungry data centers from an overstretched grid. What that pitch glosses over is that the hardware itself is stitched into the very geopolitical threads it claims to bypass.

Monday marks the cutoff for shareholders to seek lead-plaintiff status in the securities class actions piling up against the fuel-cell maker and several of its top executives. At the heart of the complaints is an allegation that Bloom routed scandium-bearing materials out of China through intermediaries in Thailand, Japan and South Korea while failing to give the capital markets an honest account of how exposed it really was.

Four Alleged Supply Routes, One Delaware Plant

The litigation traces back to a July 8 report from Hunterbrook Media, which flagged four purported channels through which scandium oxide and scandium-laced powders and ceramics are said to have reached a facility in Delaware, either directly or via Asian partners. A case overseen by Robbins Geller before a federal court in California leans on that reporting, arguing the company played down the true scale of potential tariffs and sourcing risks.

Regulatory filings cited in the suit sketch a starker picture than the corporate narrative. Roughly 70% of the rare metals used in certain assemblies are said to originate in China, and a single South Korean intermediary bought 127 billion won worth of goods from its Chinese parent in 2025. Management had previously guided toward a 29% gross margin — a figure the plaintiffs say rested on an incomplete disclosure of where the raw materials actually came from, leaving US tariffs an understated threat to profitability.

Should investors sell immediately? Or is it worth buying Bloom Energy?

A Market That Shrugged

Wall Street, for its part, has shown little appetite for the legal noise. The stock tumbled nearly 6% on the day the Hunterbrook report landed, but that dip has since proven fleeting. Shares climbed 8.5% on Friday to close the week at EUR 254.50, bringing the year-to-date gain to 239%.

The rally has been fueled by the buildout of power-thirsty data centers, with Morgan Stanley analysts recently noting that demand for computing capacity is likely to outstrip available energy for years to come. On-site generation is viewed in many corners of the market as the bridge across that gap. Even after a 2.4% pullback to EUR 247.50 in Monday's session, the stock carries a trailing price-to-earnings ratio north of 300 — a valuation that bakes in near-flawless execution and leaves little room for doubt about supply-chain stability.

The Structural Nerve

None of this means the underlying issue can be waved away. The allegations touch a raw nerve for Western technology firms: dependence on critical minerals concentrated in a handful of hands. Should trade tensions escalate or regulators scrutinize procurement relationships more aggressively, delays and rising material costs could eat into margins.

Class actions of this kind are a familiar companion for US growth stocks, typically dragging on for years and often settling. Missing Monday's lead-plaintiff deadline does not bar investors from later recoveries, but the date does mark a shift in how the case is perceived. For those holding the stock, the question is no longer whether the AI power story is real — it is whether the foundations beneath that story can withstand the scrutiny now aimed at them.
