A federal appeals court's refusal to move Bayer's sprawling glyphosate settlement out of state court has cleared the way for a pivotal hearing in Missouri, where a judge will weigh final approval of a $7.25 billion class agreement. The proceeding, held Monday before Judge Boyer in the Missouri Circuit Court, is unlikely to produce an immediate ruling, though market participants expect the session to reveal how the bench views objections lodged against the deal.

Investors greeted the moment with optimism. Bayer shares climbed 3.0% to EUR 49.65, narrowing the gap to a 52-week high of EUR 53.86 touched in early July.

The legal backdrop has shifted in the company's favor over recent months. On August 27, the Eighth Circuit Court of Appeals turned down a request from objectors seeking to transfer the settlement decision to a federal venue. Earlier, on June 25, the U.S. Supreme Court's ruling in the Durnell case bolstered Bayer's position by holding that the federal pesticide law bars failure-to-warn claims when the EPA has confirmed a product's safety.

Oncology Win Adds to Pharma Tailwind

Progress on the pharmaceutical side has reinforced the positive mood. The FDA granted accelerated approval on September 9 for sevabertinib as a first-line treatment in patients with HER2-mutant non-small cell lung cancer. The decision rests on data from the Phase I/II SOHO trial, which enrolled 69 patients and produced a 75% objective response rate, with responses lasting at least six months in 73% of those cases. The nod widens the drug's label beyond its earlier use in previously treated patients.

Should investors sell immediately? Or is it worth buying Bayer?

Bayer has not confined its pipeline ambitions to oncology. Last Wednesday the company launched a Phase II study of a GIRK4 inhibitor in patients with atrial fibrillation, one of the most common heart rhythm disorders and a sizable market opportunity should the approach hold up in later trials. A day earlier, Bayer unveiled a commercial partnership with Finland's Neste to scale Newgold winter rapeseed for biofuel production, pairing its seed expertise with Neste's refining and distribution network to tap growing demand for renewable fuels.

Barclays Lifts Target as Operations Improve

Analysts have taken note. Barclays raised its price target on Bayer from EUR 60 to EUR 70 last Tuesday while reaffirming an "Overweight" rating, pointing to value upside beyond current market levels.

The operational picture supports that view. In early August, Bayer reported first-half 2026 revenue of EUR 24.277 billion on a currency- and portfolio-adjusted basis, up 3.3%, with adjusted EBITDA rising 6.6% to EUR 6.597 billion. Management also refined its full-year 2026 net debt target through a partnership with Apollo, now aiming for EUR 29 billion to EUR 30 billion.

Shares closed Friday at EUR 48.19, down roughly 1% on the week and still well below their summer peak — a sign the market has digested recent operational gains with caution. Even so, the stock is up 30% year-to-date, underscoring that its recovery from last year's lows remains intact. The Roundup litigation continues to weigh on valuation, leaving investors to balance pipeline momentum against legal uncertainty that Monday's hearing may — or may not — begin to resolve.
