AppLovin's Data Moat Under Siege: Court Loss, Class Action, and a Cautious Piper Sandler

AppLovin's grip on the advertising data flowing through its MAX auction platform is facing its most serious challenge yet — and the market is taking notice. Shares of the digital advertising specialist shed 5.0% on Friday to close at EUR 237.85, a decline that landed just as Piper Sandler reaffirmed its "Neutral" rating on the stock with a $325 price target.

The timing is hardly incidental. The brokerage's cautious stance rests on three pillars: growth in ad inventory, intensifying competition, and the company's legal standoff with Unity Technologies. Coming immediately ahead of AppLovin's third-quarter 2026 results, those concerns carry outsized weight.

A Courtroom Setback in San Francisco

At the center of the storm is a ruling from the San Francisco Superior Court, which declined AppLovin's request for a preliminary injunction against Unity's Ad Quality SDK. AppLovin alleges the developer tool siphons data from advertisements served through MAX, potentially feeding that information into Unity's own models. Unity has firmly denied the accusations.

The decision represents a procedural blow rather than a final verdict — AppLovin's underlying claims remain unresolved — but it weakens the company's hand in the ongoing dispute. Market participants now worry that AppLovin may be unable to shield MAX-generated data to the degree it had hoped.

Should investors sell immediately? Or is it worth buying Applovin?

How far the relationship has deteriorated became clearer on Tuesday, when trade publication Digiday reported that the feud over data collection has escalated sharply. AppLovin insisted its own Ad Review tool exists solely to moderate ads served through MAX, does not build user profiles, and is not used to train proprietary models. Back on September 16, CEO Adam Foroughi argued that ad quality verification tools must be able to flag problematic placements without harvesting user-level data from rival ad networks.

The stakes could hardly be higher. In a fiercely competitive landscape, user data is the currency that matters. Should Unity succeed in gaining deeper visibility into ad flows via its SDK, AppLovin's auction mechanics could take a meaningful hit — which is why this fight is no legal footnote but a direct assault on the foundation of MAX's market power.

Class Action Adds to the Pressure

Operational battles with rivals are only part of the picture. AppLovin also faces mounting legal pressure from the investor side. According to media reports, a securities class action has been filed against the company, with law firms flagging a deadline of November 16, 2026 for lead plaintiff motions.

The complaint centers on progress in AppLovin's in-house AI models and delays in generative AI video advertising tools. These allegations remain claims in an active proceeding, not established facts. Even so, they weigh on sentiment precisely because they target the growth promises that many market participants had banked on.

Scale Alone Won't Calm Nerves

Despite the recent setbacks, AppLovin still carries considerable heft. With a market capitalization of EUR 83.93 billion, it ranks among the sector's heavyweights. The stock, however, trades 62% below its 52-week high — a stark measure of how much confidence has eroded in recent months.

That combination of procedural setbacks, rising competitive pressure, and pre-earnings warnings argues against premature optimism. As long as the protection of platform data remains unresolved, the risk-reward balance appears tilted against investors. The company's challenge is twofold: defend its technological core in court while convincing a skeptical market that its growth story still holds.
