Works Council Pacts Now Face Legal Void Without Formal Votes, German Court Rules

A January ruling from Germany's Federal Labor Court (BAG) has thrown a new procedural requirement into the day-to-day work of company-level employee representatives. Works agreements signed only by the council chair are no longer enforceable unless the full body passed a formal resolution at the time – even if management and workers have already been operating under the deal for months or years.
The decision, handed down on 27 January 2026, is already prompting change. The Max Planck Institute for Biology in Tübingen is hiring an assistant for its works council, a part-time role with 15.6 hours per week (40 percent of a full-time equivalent). Pay follows the federal public-sector collective agreement (TVöD Bund) up to salary grade 6. The contract is initially limited to two years, with an option to extend.
The timing is sensitive for the Tübingen campus. BioNTech announced in May 2026 that it would close its local site, while U.S. pharmaceutical company Moderna has recently emerged as a potential buyer.
Across Germany, the BAG ruling is raising the stakes for councils to keep meticulous minutes and ensure every agreement is backed by a recorded vote. "Protocols and resolution tracking are not bureaucratic red tape – they are decisive for the legal validity of works council work," the court's message implies.

The demand for professionals who understand these rules is growing. Amazon is currently advertising for Senior HR Business Partners who must have demonstrable experience cooperating with works councils. Meanwhile, the food-and-hospitality union NGG is recruiting new members for youth and trainee representation bodies in the Steinfurt district, with elections running until the end of November. The union says a rising number of young employees are filing complaints.
Good works council practices are also being rewarded. The shortlist for the 2026 German Works Council Prize was announced in mid-June. Awards will be handed out in Berlin on 16 September. Nominees include councils from Airbus Operations, Brose Fahrzeugteile, and pharmaceutical distributor Sanacorp. Their projects range from hybrid work models and preventive health care to strategic co-determination.
IG Metall Bayern recently reported a positive result from the latest works council elections, claiming its candidates won roughly 74 percent of all mandates in the union's sector. Yet challenges persist. In the Tyrolean Stubaital valley, accusations of election obstruction emerged in mid-June at a hotel. The case underscores that works council activity remains a legally fraught field.
