A Munich court has delivered a mixed ruling in the ongoing intellectual property dispute between high-performance computing specialist ParTec and chip giant NVIDIA. The Unified Patent Court in Munich dismissed a patent infringement claim brought by ParTec in the first instance. However, the judgment contained a pivotal element that the company is interpreting as a strategic partial victory, strengthening its position for the legal battles ahead.

Court Upholds Patent Validity as Core Issue

While the court determined that NVIDIA's use of its current technology does not infringe upon patent EP 3 743 812 B1—finding the required quality criteria were not met—it simultaneously affirmed the fundamental validity of the patent itself. This technology is considered a crucial component for efficient AI supercomputers. ParTec views the validation of the patent's legitimacy as a confirmation of its innovative capabilities and a reinforcement of its negotiating stance within the industry.

The immediate consequence of this decision is an appeal. ParTec and its co-plaintiff, BF exaQC, have announced they will challenge the first-instance ruling.
