Nintendo of America has initiated a major legal challenge against the United States government. The lawsuit, filed on March 6, 2026, at the U.S. Court of International Trade, demands the full reimbursement of tariffs the company paid, plus accrued interest. This legal move follows a pivotal February 2026 Supreme Court ruling that declared the punitive tariffs imposed during the Trump administration illegal.

A Multi-Billion Dollar Dispute

The complaint names several U.S. government bodies as defendants, including the Department of the Treasury, the Department of Homeland Security, and U.S. Customs and Border Protection. Nintendo’s legal argument centers on the claim that the duties, levied under the International Emergency Economic Powers Act (IEEPA), were unconstitutional and inflicted "immediate and irreparable harm" on the business.

The gaming giant is not alone in this fight. Other corporations, such as FedEx and Costco, have filed similar suits. The scale of the issue is monumental: according to government estimates, between $166 billion and $200 billion in tariffs were collected while the measures were active.

Direct Impact on Operations and Consumers

The tariffs, which took effect in early 2025, had immediate and tangible consequences for Nintendo’s business. Court documents reveal that the company was forced to delay pre-orders for the Switch 2 console in the U.S. and Canadian markets when the device was unveiled on April 2, 2025.

Furthermore, the import taxes compelled Nintendo to increase retail prices. In the summer of 2025, the company raised the selling price for the standard Switch model, the OLED version, and the Lite edition. Associated accessories also saw significant price hikes.

Roadblocks to Reimbursement

Despite a judicial order mandating refunds, the repayment process has stalled. Customs authorities cite technical limitations within their IT infrastructure, describing the volume of required reimbursements as unprecedented. Work is currently underway on a new administrative system, which is projected to be operational within 45 days. However, the timeline for when Nintendo and other plaintiffs will actually receive their funds remains uncertain.
