Germany’s partial cannabis legalisation is creating a widening gap between booming medical demand and stubborn workplace restrictions. While private consumption has been lawful since April 2024, employers retain sweeping powers on their premises, and a growing number of insurers are refusing to cover the rising costs of prescribed cannabis.

According to doctors in North Rhine-Westphalia, the number of medical cannabis prescriptions has jumped by 60 percent. Any licensed physician in Germany can prescribe cannabis-based medicines, but the expense is steep: an initial consultation runs between €50 and €150, and pharmacy-priced cannabis costs €8 to €15 per gram. Statutory health insurers are supposed to cover these only for severe illnesses — yet reports indicate they reject more than 40 percent of applications.

At the same time, the boundary between legal private use and permissible workplace conduct remains contested. Employers can, under the company’s house rules and the managerial directive rights set out in the Gewerbeordnung, ban cannabis entirely from company property. However, a blanket prohibition on off-duty consumption is legally unenforceable as long as an employee’s performance is not impaired. In firms with a works council, any consumption rules must be negotiated collectively.

The German Social Accident Insurance (DGUV) prohibits workers from being on site while intoxicated if this poses a danger. Unlike alcohol, cannabis lacks a binding intoxicant threshold for the workplace. Since August 2024, road traffic law has set a limit of 3.5 ng/ml THC in blood serum, and many companies now use that as an informal benchmark for internal policies.

A recent study by Sucht Schweiz found that cocaine use is widespread in sectors such as hospitality, construction and entertainment, where it is often used instrumentally — to boost efficiency or creativity. Addiction counsellors recommend that employers confronted with signs of substance abuse prioritise prevention and support over punishment. Still, serious offences or gross misconduct can justify termination. In early 2025, the Labour Court of Lower Saxony ruled that company-wide employee surveys aimed at investigating crimes are permissible, provided they meet data-protection standards.

On the research front, progress is visible but cautious. In May 2026, the US Food and Drug Administration granted breakthrough therapy designation to the drug candidate VER-01, developed by the company Vertanical. In a Phase 3 trial, the treatment for chronic lower back pain outperformed opioids. A European market launch under the brand name Exilby is being prepared.

Yet the same year, a meta-analysis flagged a 29 percent increase in depression risk among cannabis users, with risk climbing further for heavy consumers. Current medical guidelines therefore advise against using cannabinoids to treat depressive disorders.
