A growing compliance burden is landing on Germany’s municipalities at a time when most can no longer balance their books. Eight in ten communes in Baden-Württemberg—a state often seen as economically robust—say they cannot present a balanced budget for 2026, according to surveys by the local Gemeindetag. That squeeze leaves scant room for voluntary safety measures beyond legal minimums, even as new workplace and cyber-security rules demand swift action.

Safety-Officer Threshold Raised, but Experts Urge Caution

Since 29 May 2026, the threshold for appointing workplace safety officers has changed. Under the updated Siebte Buch Sozialgesetzbuch (SGB VII), the mandatory threshold rises from 20 to 50 employees. Companies with 21 to 49 staff now only need a safety officer if specific hazards exist. For small and medium enterprises—defined as fewer than 250 workers—a single officer suffices, provided no unusual risks are present.

Despite the cut, accident-insurance experts advise keeping existing safety officers in place for now. The relevant DGUV Vorschrift 1 is being revised, and ignoring the appointment duty can bring fines of up to €10,000. “Companies should not rush to dismantle structures that work,” one industry analyst noted.

Cyber-Security Mandates Hit Public Sector Hard

Parallel to the physical-safety reforms, a major cyber-security law came into force at the start of 2026. The NIS-2 Implementation and Cyber-Security Strengthening Act (NIS2UmsuCG) imposes new requirements on public bodies in regulated sectors such as energy, transport, and healthcare. The trigger: more than 50 employees or annual revenue exceeding €10 million.

Affected entities must register with the Federal Office for Information Security (BSI), implement technical and organizational measures (TOMs), and set up an incident-reporting system. Digital Tools and Deregulation Experiments

The cost of meeting new standards is thrown into relief by a case from neighbouring Switzerland. The canton of Bern set aside roughly 390 million Swiss francs for cleaning up PFAS-contaminated sites—a reminder that environmental and safety liabilities can hit budgets hard.

In Germany, many local authorities are already raising taxes to keep afloat. The city of Wedel sharply increased its Grundsteuer B rate, while Eppertshausen decided in early June to introduce Grundsteuer A from January 2027. With 85 percent of Baden-Württemberg’s communes unable to present a balanced budget this year, the margin for anything beyond mandatory safety investments remains razor-thin.
