The incident has reopened a debate about the duty of developers to inform contractors about hazardous materials. The project company involved had given the firms a written guarantee that the building was asbestos-free. That assurance has now collapsed, raising questions about criminal and civil liability.

Germany’s Federal Court of Justice (BGH) clarified the distribution of risk during the renovation of contaminated buildings in a ruling handed down on 15 January (case number VII ZR 119/24). The case centred on tar-containing waterproofing membranes found in an office complex. The court drew a clear distinction between the parties involved: the planning supervisor bore 80 percent contributory negligence, while the coordinating engineer was held fully liable. Experts from a specialist academy for surveyors stress that especially for external thermal insulation composite systems, comprehensive inspection and warning obligations apply.

New Law Tightens Renovation Requirements

On 10 July, both chambers of the German parliament passed the Building Modernisation Act. Under the new rules, the 16 percent of non-residential buildings with the worst energy performance must be upgraded by 2030, with the share rising to 26 percent by 2033. Monitoring greenhouse gas emissions across the full life cycle becomes mandatory: from 2028 for new builds above 1,000 square metres, and from 2030 for all new builds. Industry experts warn against reducing modernisation to heating alone. They call for a holistic strategy that includes building automation for systems above 70 kilowatts.

The same day the law passed, around 80 firefighters were mobilised in Weil am Rhein to stop a leak of the chemical xylene at a transshipment depot. By cooling and depressurising the tank container, crews prevented any danger to the public.
