A survey released Friday reveals deep skepticism among German building professionals about treating technical standards as legally binding by default. The poll, conducted by the German Institute for Preventive Fire Protection (DIvB) with around 150 specialists, found that 79 percent oppose the judicial presumption that DIN norms automatically qualify as accepted technical rules – a stance that could reshape how architects and contractors manage liability in construction projects.

DIvB Managing Director Axel Haas called the result clear evidence against the current practice. Support also came from the judiciary: the presiding judges of the Vth and VIIth Civil Senates at the Federal Court of Justice (BGH) stated that such a presumption cannot simply be transferred to construction contract law. The DIvB is already part of a working group at the Federal Building Ministry that is reassessing how standards are classified legally.

Under the same plan, digital construction applications will become mandatory from 2028 – paper submissions will remain only in hardship cases. From 2027, new-build subsidies will be consolidated into a single central program, with bonuses for serial construction methods.

Three Tiers to Replace the Norm Maze

Just yesterday, the National Regulatory Control Council (NKR) called for a deeper reform. Its proposal: builders could choose from three quality levels – simple, medium, or high. On the simple tier, only safety-critical requirements like structural stability, fire protection, and sound insulation would be mandatory.

NKR member Dorothea Störr-Ritter described the current system as error-prone. The goal, she said, is to strengthen contractual freedom and reduce the liability risk for architects and construction firms when they deliberately depart from non-safety-related DIN standards.

Industry Warns of New Legal Uncertainty

The ARGE Baurecht (Working Group on Construction Law) expressed concerns today. While it welcomed the clarification that DIN norms do not enjoy automatic legal recognition, it warned that the "Gebäudetyp E" introduces fresh risks. Terms such as "simple standard" or "contemporary usability" remain legally undefined.

Attorney Yannic Linnemann cautioned that the new rules could impose extensive disclosure obligations on planners. "This does not necessarily mean less bureaucracy – it merely shifts the legal focus and the burden of proof in case of disputes," he said.
