Birth Rate Drop Fuels Parental Leave Overhaul as German Courts Tighten Job Protection

Germany’s falling birth rate — down to 1.32 children per woman in 2025, the lowest since the late 1990s — has become a political flashpoint as the government pushes ahead with reforms to parental benefits and job-protection rules. Economic uncertainty and persistent inflation, according to researchers at the Federal Institute for Population Research, are driving the decline. In response, the coalition is weighing cuts to the duration of parental allowance, even as courts and opposition lawmakers argue for stronger family support.
Job Protection Resets Before Each Parental Leave Block
The Federal Labour Court (BAG) ruled on 18 June 2026 that the special dismissal protection for parents on leave must be assessed separately before every individual parental leave period. Even if an employee requests multiple blocks in a single written application, the protective window opens anew for each phase — a decision that shifts risk squarely onto employers.
In one case, the court declared a dismissal invalid because the employer had fired the worker during the eight-week pre-notice period just before a second parental leave block began. A follow-up ruling on 29 June 2026 confirmed: dismissals issued shortly before the start of a later leave segment are unlawful. Employers now face a duty to check, before terminating anyone, whether further parental leave periods have already been registered.
Bonus Payments Can Be Scaled Back
The BAG also clarified that variable compensation may be reduced proportionally during parental leave — even when no explicit clause exists in the company’s works agreement. The logic: no work, no pay. In a concrete case, an employee had exceeded his targets but was absent for 62 days due to parental leave. The pro-rata cut was lawful.
Paperwork Streamlined, Income Threshold Raised
Since 1 May 2025, applying for parental leave has become simpler. For children born on or after that date, a request in text form — an email suffices — is enough. The earlier requirement for a handwritten signature is gone. This applies to part-time work requests during leave and to employer responses alike. Deadlines remain unchanged: seven weeks’ notice for children under three, and 13 weeks for those aged three to eight.
Starting 1 April 2025, the income limit for receiving parental allowance (Elterngeld) rose to €175,000 in taxable annual household income per child.
Cuts to Single-Parent Support
On 12 July 2026, Family Minister Karin Prien announced major changes to the advance maintenance payment (Unterhaltsvorschuss) for single parents. Going forward, the benefit will be paid only until a child turns 15 — down from the current age of 18. The reason: costs have ballooned since the 2017 reform. To recover more of the money it advances, the ministry plans stricter penalties for defaulting parents, including possible driving licence revocations.
Parental Allowance Reform in the Crosshairs
The government is planning to shorten the basic parental allowance period from 14 to 12 months, while raising the minimum monthly payment from €300 to €330 and the maximum from €1,800 to €1,900. Opposition parties counter that, given the skilled-labour shortage and the need for better work-family balance, the allowance should stretch to 18 months with significantly higher funding levels. The debate continues as policymakers search for a formula that reverses the demographic trend without straining the federal budget.
