Bayer’s shares are navigating a precarious technical and legal landscape. After shedding roughly 11% in the past week, the stock edged up 0.8% on Monday to €34.22 — a modest bounce that leaves it well below the 200-day moving average of €35.73, a level widely viewed as the dividing line between structural strength and weakness.

The chemical and pharmaceutical group is under pressure from two antitrust fronts in the US seed market, while also awaiting a potentially pivotal Supreme Court ruling on glyphosate liability. These legal headaches are compounding a chart that already looked fragile.

Antitrust Clash Over Maize Genetics

A fresh lawsuit filed in US federal court accuses Bayer CropScience of monopolising the market for genetically modified maize seeds, specifically through its NK603 Roundup-resistant trait. Approximately 92% of US maize acres use herbicide-tolerant seeds, and the vast majority carry Bayer’s NK603 trait. The plaintiff, Latham, alleges that the company continued to collect licensing fees even after the patent expired in 2022, and actively prevented independent firms from freely using the genetic material.

The complaint, brought under the Sherman and Clayton Acts, seeks treble damages. Bayer has rejected the allegations and pledged to defend itself in court.

The case arrives as a separate US Department of Justice investigation remains active. In May, Bayer struck a settlement with the DOJ’s Antitrust Division, agreeing to remove a requirement that independent seed companies meet sales targets to qualify for rebates under its “Premier Performance Program”. The company committed not to reintroduce that coupling of maize and soybean seeds for seven years. Yet the DOJ explicitly stated that its broader probe into the agricultural seed market continues.

Supreme Court Decision Looms

Beyond the antitrust arena, Bayer faces a fundamental test this month in the US Supreme Court case Durnell. The justices will decide a key question on the scope of glyphosate-related claims. If the ruling favours Bayer, it could strip the legal foundation from thousands of pending Roundup lawsuits — a outcome that would almost certainly move the shares.

Technical Picture Deteriorates

The chart offers little comfort. At €34.22, the stock sits roughly 4% below the 200-day moving average of €35.73, a level that has acted as a ceiling. The 50-day average stands at €38.49 and the 100-day average at €40.64 — both well out of reach.

Over the past month, the stock has shed 7.8%, and the year-to-date decline stands at roughly 10%. The 52-week high of €49.93, recorded in February, now lies more than 31% away. The relative strength index at 44.1 signals neither oversold nor overbought territory, but leans slightly bearish. Annualised 30-day volatility of 36% increases the risk of false signals around key technical thresholds.

Fundamentals Offer Little Support

Operationally, Bayer confirmed its full-year guidance on a currency-adjusted basis and announced plans to acquire Perfuse Therapeutics to bolster its pharmaceutical pipeline — a move that strengthens the narrative but has done little to arrest the slide. First-quarter sales fell to €13.41bn, down roughly 2.5% year on year.

The near-term focus remains the €35.73 level. A clean break above it on strong volume could open the path to the 50-day average. Failure, however, would likely reignite selling pressure and test recent lows.
