- NCLAT found a genuine pre-existing dispute over credit notes, delivery charges and account reconciliation.
- Polycab can resume independent operations through its board after the insolvency admission was set aside.
- The underlying commercial dispute with Asier Metals still requires further examination.
Polycab India received legal relief on Friday, October 30, after the National Company Law Appellate Tribunal set aside insolvency proceedings initiated against the wires and cables maker. The ruling allows the company to function independently through its board of directors with immediate effect, according to Devdiscourse, which carried an ANI report.
Tribunal rejects insolvency admission
A three-member NCLAT bench allowed an appeal filed by suspended director Bharat Ajay Jaisinghani and overturned the October 7 order of the National Company Law Tribunal in Ahmedabad. That order had admitted a petition by Asier Metals Private Limited over an alleged operational debt of about INR 2.78 crore.
The dispute concerns supplies of non-ferrous metal ingots. Polycab argued that credit notes, discounts, detention and demurrage charges, provisional billing and account reconciliation remained unresolved. NCLAT said the correspondence between the parties showed a genuine pre-existing dispute that needed further examination before insolvency proceedings could be admitted.
The appellate tribunal also set aside consequential NCLT orders and released Polycab from the Corporate Insolvency Resolution Process. For investors, the decision removes the immediate insolvency admission, while the underlying commercial disagreement remains the key legal issue to monitor.
Business remains focused on cables
Polycab describes itself as India's No. 1 wires and cables company, with electrical and electronic products sold through a broad distribution network and in more than 70 countries. Its portfolio also includes lighting, water heaters, switches and accessories, while the company says it is expanding its fast-moving electrical goods business and export presence.
The competitive set includes KEI Industries, RR Kabel and Havells India. Polycab presents itself as the leading national wires and cables specialist in that group, while its additional consumer electrical businesses give it a broader product mix than a pure cable manufacturer.
