Maui Land & Pineapple is facing a federal lawsuit in which TY Management alleges that the company improperly passed repair and capital-improvement costs on to irrigation customers. Honolulu Civil Beat reported on October 16, 2026, that the complaint accuses the company of disguising major repairs as routine maintenance.

Water billing allegations

TY Management, which owns two golf courses at Kapalua Resort, says Maui Land & Pineapple was permitted to recover routine operating and maintenance costs but not repairs, replacements or capital improvements. The complaint alleges that at least USD 447,000 of such costs from 2025 were mislabeled to justify higher charges.

The lawsuit also alleges that the irrigation rate charged to TY Management increased by 339% between January 2025 and January 2026, from USD 0.49 to USD 2.15 per thousand gallons. The allegations have not been adjudicated.

Company rejects the allegations

Maui Land & Pineapple said the lawsuit is an effort by TY Management owner Tadashi Yanai to pressure the company into transferring control of the Honokohau Ditch System. The company called the claims meritless and said it would defend itself. Hawaii Water Service, which is also named in the case, said it had not yet been served and would defend against the allegations.

Potential public transfer

The dispute adds legal uncertainty around a water system serving residents, farmers, hotels and resorts in West Maui. Maui Land & Pineapple and Maui County signed a non-binding agreement in May to transfer control of most of the system to the county; that process remains pending.
