AI liability terms reshape customer risk

  • Wells Fargo's revised Online Access Agreement takes effect on November 24, 2026.
  • The terms treat actions initiated by an authorized AI agent as the customer's instructions, subject to applicable law and regulation.
  • Customers must supervise agents, revoke access properly and retain evidence of revocation.

Wells Fargo is moving responsibility for customer-authorized artificial intelligence agents onto account holders under an updated Online Access Agreement. A review published by Cakewalk on October 27 says the new provisions take effect on November 24, 2026.

Wells Fargo's Section 15 defines an AI agent broadly as software that acts on behalf of a person, whether autonomously or not. Once a customer authorizes an agent or gives it account access, instructions, actions and transactions initiated by that agent will be treated as if they were initiated and authorized directly by the customer, without further verification.

Customers carry the monitoring burden

The agreement makes customers responsible for supervising an agent and keeping it within the authority granted to it. The stated risk also covers unintended actions, manipulated inputs and activity that exceeds the agent's authority, subject to applicable law or regulation. Wells Fargo says it does not monitor, screen or review AI-agent activity.

Customers must also revoke an agent's authorization properly and promptly, retain evidence of the revocation and provide that evidence to the bank on request. Responsibility continues until Wells Fargo is notified, to the extent permitted by law. The agreement separately gives the bank the right to limit, suspend or terminate an agent's access and to require agent registration.

Wells Fargo stock traded at 79.01 euros on Lang & Schwarz at 15:03 CET on Thursday, November 5, 2026. Investors should distinguish the contractual position from the eventual legal treatment of disputed transactions: the agreement itself preserves exceptions for applicable law and regulation.

For investors, the change highlights a developing control issue for banks as software receives greater access to payment and account functions. It may reduce Wells Fargo's stated contractual exposure to some agent-related disputes, while increasing scrutiny of customer protection, authentication and oversight standards.
