Wells Fargo is preparing new online banking terms that place the risk of customer-authorized artificial intelligence agents largely on the customer. The changes take effect on November 24, 2026, according to a legal analysis published by Hunton Andrews Kurth on November 3.
Section 15 of the updated Online Access Agreement covers third-party artificial intelligence agents and agentic AI. The analysis says Wells Fargo will treat instructions, actions and transactions initiated by an AI agent as if they were initiated and authorized directly by the customer, without further verification. The provisions remain subject to applicable law or regulation.
Customers Carry More Supervisory Risk
The agreement states that customers use AI agents at their own risk and are responsible for supervising them. That responsibility includes unintended actions, errors arising from an agent's interpretation of instructions, manipulated inputs and activity that exceeds the authority granted by the customer.
Wells Fargo also says it does not monitor, screen or review AI-agent activity under the terms described by Hunton Andrews Kurth. Customers that revoke an agent's authority must retain evidence of the revocation and provide it to the bank on request. Until the bank is notified, the customer remains responsible for the agent's activity to the extent allowed by law or regulation.
The provisions do not amount to an outright ban. Wells Fargo reserves the right to require customers to register their agents, change access methods or limit, suspend or terminate an agent's access. The terms therefore leave the bank with broad control over whether and how agent access is permitted.
Regulatory Questions Remain
The bank's approach highlights an unresolved issue for digital banking: how responsibility should be divided when software acts with a customer's credentials but behaves differently from the customer's instructions. Hunton Andrews Kurth said major banks are responding by blocking credential-based agent access or reallocating the risk through customer agreements, while read-only access through open banking connections remains a separate channel.
For Wells Fargo, the immediate investor issue is the effect of the new terms on customer trust, fraud controls and future digital-banking features. The agreement provides a framework for agent access, but the practical scope of permitted agents and any later regulatory response will determine how significant the change becomes.
