US officials have delayed approval for semiconductor equipment that SK Hynix wants to use at its Dalian plant in China, putting the financing and timing of a proposed NAND expansion in New York under pressure. Reuters reported the developments on Tuesday, November 3, citing people familiar with the matter.
Licensing dispute reaches New York
SK Hynix is seeking US export licenses for equipment to expand production at Dalian. The company has argued that higher output there would help generate the revenue needed for its planned US investment, while also supporting its competitiveness in advanced NAND memory.
Solidigm, SK Hynix's US subsidiary, is pursuing a project with an initial investment of 45 billion US dollars to build two NAND plants in Marcy, New York, according to people cited by Reuters. The long-term investment could reach 100 billion US dollars. NAND memory retains data when power is removed and is widely used in data-center storage.
Approval for the Dalian expansion has become central to the New York plans. Solidigm executives have met with officials from the US Department of Commerce nearly 10 times since late August, as the company refined its license applications and discussed the proposed US facility.
Washington keeps options open
The Commerce Department has not formally denied the request to ship US equipment for the Dalian expansion. However, a Commerce official maintained in a meeting last week that Washington did not want to allow American chipmaking tools to expand capacity or upgrade technology in China.
A separate licensing discussion covers equipment needed to keep the Dalian operation running in 2027. Reuters said Treasury officials were also involved because the department would have to waive outbound investment restrictions for SK Hynix to purchase tools for China. The negotiations therefore affect both the near-term operation of Dalian and the financing logic behind the New York proposal.
Solidigm said it is exploring potential locations around the world for a NAND fab and that no decision on a specific site has been made. SK Hynix also said in an October 23 statement that expanding Solidigm's production capacity and strengthening its competitiveness remain important priorities. The proposed New York facility remains contingent rather than a committed construction project.

For shareholders, the licensing process creates a policy risk around a large proposed investment while leaving the strategic rationale intact: SK Hynix wants additional Dalian output to support its US manufacturing ambitions, but Washington is weighing that request against restrictions on semiconductor technology transfers to China. The next significant milestone is a decision on the requested licenses and the related New York site plans.
The broader semiconductor market remains sensitive to US-China technology policy. See the latest current market reports.
