SK Hynix stock faces a US licensing hurdle linked to its China expansion. Solidigm's proposed New York NAND investment remains undecided.

Licensing Risk Meets Expansion Plans

  • US export approvals for equipment intended to expand SK Hynix production in Dalian remain unresolved.
  • Solidigm is considering two NAND plants in New York, but no specific investment decision has been finalized.
  • The licensing outcome could determine how quickly SK Hynix can expand its US manufacturing footprint.

US officials have held up approval for American chipmaking equipment that SK Hynix wants to use to expand production at its Dalian, China, facility, Reuters reported on Tuesday, November 3. The licensing dispute has complicated plans by the company's US subsidiary Solidigm to build new NAND memory plants in New York.

Reuters said SK Hynix has argued that higher output at Dalian would help finance its US expansion. Solidigm is considering an investment of about 45 billion US dollars for two NAND plants in Marcy, New York, with the commitment potentially rising to 100 billion US dollars over time.

China Approval Holds Key

The US Commerce Department has not formally rejected the request, but approval for equipment intended to expand or upgrade the Dalian operation remains pending, according to people familiar with the discussions cited by Reuters. A separate licensing process covers equipment needed to maintain the facility in 2027.

The disagreement centers on whether installing equipment in available cleanroom space would amount to a prohibited capacity expansion. Commerce Under Secretary Jeffrey Kessler reportedly maintained last week that Washington did not want to permit additional American chipmaking tools for expanding or upgrading production in China.

SK Hynix has prepared several versions of its license applications while discussions continue. Company representatives have also met with the US Treasury Department, which could need to waive outbound investment restrictions for equipment purchases linked to China.

Solidigm Keeps Options Open

Solidigm said it is evaluating potential locations worldwide to strengthen competitiveness and serve customers, but no decision on a specific project has been finalized. That leaves the proposed New York buildout exposed to the outcome of the Dalian licensing process rather than making the reported investment a committed construction program.
