Philip Morris faces a planned criminal complaint in the Netherlands over allegations concerning its heated tobacco business. Dutch anti-smoking foundation Stichting Rookpreventie Jeugd said it intends to submit the complaint to the public prosecution service in mid-November, according to DutchNews.nl.

Allegations target product claims

The foundation alleges that Philip Morris falsely presented heated tobacco as less harmful than conventional smoking and relied mainly on company-funded studies while omitting concerning findings from independent research. It also accuses the company of promoting heated tobacco illegally through specialist shops.

The complaint is expected to be handed to prosecutors in mid-November. It is an allegation rather than a finding by a court or regulator, and the planned filing does not establish that Philip Morris committed the alleged offenses.

Health groups support action

KWF, the Dutch cancer charity, along with lung and heart foundations, the Antoni van Leeuwenhoek cancer institute and the Dutch lung doctors' association NVALT, have pledged to support the complaint. Lawyer Sjoerd Lopik said the groups believed earlier fines and settlements had not stopped further alleged violations.

The dispute adds legal and reputational risk to Philip Morris' strategy of shifting consumers toward smoke-free products. The company says on its website that smoke-free products generated 40 percent of total net revenue as of the third quarter of 2026 and were available in 110 markets. The Dutch allegations challenge the way the health and advertising claims behind that strategy are presented locally.

Earlier advertising dispute

DutchNews.nl reported that doctors and health organizations had already complained in June about a Philip Morris campaign that used an artificial-intelligence tool to help people oppose tougher European Union tobacco rules. The Dutch advertising watchdog later ruled that the campaign breached the advertising ban. A previous criminal complaint against tobacco companies filed in 2016 did not lead to prosecution.
