  • Both matters remain focused on brand protection, with the UK dispute still open to settlement.

Mondelez International ended the week with two separate trademark disputes involving major snack brands. The cases put brand protection and litigation risk in focus ahead of the key holiday selling period.

UK dispute centers on Snowballs

Mondelez has demanded that vegan chocolate maker Moo Free stop selling White Choccy Snowballs, alleging that the product name infringes Cadbury's Snowball and Snowballs trademarks. The Grocer reported that the marks were registered for chocolate confectionery in 2001 and that Mondelez's letter sought an immediate and permanent halt to sales.

Moo Free rejected the allegations as unproven and said it would prefer to keep the product name. The company also said a forced packaging change could cost tens of thousands of pounds. Mondelez told The Grocer that no legal action had been filed and that an amicable resolution remained possible.

US complaint adds another test

In a separate case filed on November 2 in the US District Court for the Northern District of Illinois, Mondelez accused candy company Joyride of infringing the trademarks and trade dress of Sour Patch Kids. The complaint alleges that Joyride's Sour Smacks packaging uses nearly identical copies of the brand's mascot and is intended to cause confusion.

Just Food via Yahoo Finance reported the Joyride complaint alongside the Moo Free dispute. The cases are separate, but together they highlight the value Mondelez places on protecting distinctive product names, packaging and visual identities.
