E-cigarettes, shisha pipes and heated-tobacco devices are now covered for the first time under a sweeping anti-smoking law that came into force in Baden-Württemberg on June 1. The southwestern German state has introduced the country’s strictest non-smoking protections, extending bans far beyond traditional tobacco products and expanding the list of public spaces where lighting up is forbidden.

Operators face the steepest penalties. First-time violators running facilities such as swimming pools, zoos, or amusement parks can be fined up to €3,330. Repeat offenders within 12 months risk a maximum of €6,500. Private individuals caught smoking in prohibited areas pay €200 for a first offence and €500 if they reoffend within the same year. Authorities expect the higher fines to act as a deterrent, especially for businesses that fail to install clear signage or stop illegal smoking on their premises.

Bus stops and train stations are now smoke-free zones. Previously only Deutsche Bahn stations restricted smoking, and even then designated areas were allowed. The new law closes that loophole: every public-transport stop in the state must be smoke-free. Municipalities and transport operators are responsible for putting up the necessary signs. In Stuttgart, security staff from the transport authority are informing passengers about the change – though they cannot issue fines themselves. Freiburg’s public-transport company has explicitly welcomed the tougher rules.

Playgrounds, school grounds, outdoor pools, and zoos are also covered. The ban applies even during school events on the premises. Organisers of festivals and operators of beer tents can still permit smoking, but only in clearly marked side rooms or separate areas. Small pubs that do not serve hot meals may also allow it, provided a visible notice at the entrance warns guests in advance.

The background is stark. In 2023, roughly 131,000 people died in Germany from tobacco-related illnesses – 13.7% of all deaths. In Baden-Württemberg alone the share was 14.7%. Public-health experts argue that the new law, which supplements the existing Workplace Ordinance (Arbeitsstättenverordnung), closes a regulatory gap that had allowed passive-smoke exposure on trains, at bus stops, and in many recreational settings. Company premises without public access remain exempt.

Implementation is proving tricky. Several local authorities are grappling with the cost of new signage and the challenge of enforcement on busy days. In Schwäbisch Gmünd, outdoor pools have already set up concrete smoking zones to comply. Legal experts stress that consistent enforcement is only legally watertight once those zones are clearly defined and signposted. Without them, operators risk fines even if they try to police the ban informally.

Gastronomy businesses retain some flexibility. Designated smoking rooms, festival tents, and small pubs without hot food can still allow smoking – but must post a conspicuous notice at the entrance. The law does not change the existing obligation of employers to protect staff from passive smoke in the workplace; it simply tightens the rules for publicly accessible buildings and outdoor spaces.
